By purchasing or using any Blue Honest device, you voluntarily and knowingly assume all such risks and agree that Blue Honest Inc. is not liable for any adverse outcomes arising from your voluntary use of the device.

Eye Safety: The PRO VX and all Blue Honest laser devices emit laser energy that can cause permanent eye injury if used improperly. Protective eyewear must be worn at all times during device operation. Protective eyewear is provided with each device. Blue Honest Inc. expressly disclaims all liability for eye injury or vision impairment resulting from failure to use provided or appropriate protective eyewear during device operation.

Photosensitivity: Individuals taking photosensitizing medications or with known photosensitivity conditions must consult a qualified healthcare provider before use. Blue Honest Inc. is not liable for photosensitive reactions arising from undisclosed medications, conditions, or failure to seek appropriate medical guidance prior to use.

9. Device Modifications and Tampering

You may not modify, disassemble, reverse engineer, tamper with, or attempt unauthorized repair of any Blue Honest device. Any such modification or tampering:

Immediately voids all warranties applicable to the device
Transfers full liability for any resulting injury, damage, or regulatory violation to the user
May constitute a violation of federal law given the FDA-cleared status of Blue Honest devices
May result in termination of your right to use Blue Honest Services and pursuit of legal remedies by Blue Honest Inc.

Blue Honest Inc. expressly disclaims all liability for any outcomes arising from use of a modified or tampered device.

10. Device Warranty

Blue Honest Inc. warrants the PRO VX and other Blue Honest devices against defects in materials and workmanship for a period of one (1) year from the date of original purchase by the original purchaser ("Warranty Period"), subject to the following conditions:

The warranty applies to the original purchaser only and is non-transferable.
The warranty covers manufacturing defects and component failures under normal use conditions as described in the product documentation.
The warranty does not cover damage resulting from misuse, abuse, unauthorized modification, improper handling, failure to follow contraindications or usage protocols, physical damage, water damage, or use outside of stated operating parameters.
To make a warranty claim, contact customerservice@bluehonest.com with proof of purchase and a description of the defect. Blue Honest Inc. will, at its sole discretion, repair or replace the defective unit or issue a refund.
Warranty service does not extend or reset the original Warranty Period. In the event that a Blue Honest device is repaired, refurbished, or replaced under warranty for any reason, including but not limited to component failure, manufacturing defect, or device malfunction, the warranty applicable to the repaired or replacement unit shall continue from the original purchase date of the initial device and shall not be reset, extended, or otherwise modified. A replacement or repaired unit carries no independent warranty beyond what remains of the original Warranty Period at the time of service. Blue Honest Inc. reserves the right to replace a defective unit with a refurbished unit of equivalent specification.
Cosmetic defects, including but not limited to scratches, scuffs, blemishes, discoloration, damaged stickers, or other surface imperfections, must be reported to Blue Honest Inc. within ten (10) days of receipt of the device. Claims for cosmetic defects reported after this period will not be accepted, as Blue Honest Inc. cannot reasonably determine whether such defects occurred prior to or following delivery. To report a cosmetic defect, contact customerservice@bluehonest.com with photos clearly documenting the defect within the ten (10) day window. Cosmetic defects that do not affect device functionality are not grounds for return or refund but may be addressed at Blue Honest Inc.'s sole discretion.

EXCEPT AS EXPRESSLY SET FORTH IN THIS WARRANTY, BLUE HONEST INC. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

11. Resale, Transfer, and Downstream Liability

If you resell, transfer, loan, or otherwise make available any Blue Honest device to a third party, whether for compensation or otherwise, you expressly acknowledge and agree to the following:

You assume full liability for any and all claims, damages, injuries, or regulatory violations arising from such resale, transfer, or downstream use.
You are responsible for ensuring that any recipient of a Blue Honest device receives and reviews all product documentation, contraindications, and usage protocols prior to use.
Blue Honest Inc. bears no liability for the use of its devices by any party other than the original purchaser, and any downstream user's recourse is solely against the transferring party.
Resale of Blue Honest devices for commercial purposes may be subject to additional distributor or reseller agreements. Unauthorized commercial resale is prohibited without prior written consent from Blue Honest Inc.

Your failure to use required protective equipment including but not limited to protective eyewear during device operation

23. Force Majeure

Blue Honest Inc. shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, regulatory changes, supply chain disruption, labor disputes, or failure of third-party service providers. In such events, Blue Honest Inc. will make reasonable efforts to notify affected customers and resume normal operations as quickly as practicable.

24. Dispute Resolution and Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Website, or any Blue Honest product or service — including disputes regarding the existence, validity, or termination of these Terms — shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as otherwise provided herein.

Class Action Waiver: You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against Blue Honest Inc. All disputes must be brought in your individual capacity only.

Exceptions: Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. Small claims court actions within applicable jurisdictional limits are also exempt from this arbitration requirement.

Arbitration shall take place in Rockingham County, New Hampshire. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

25. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall still be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions.
